A 40 year old man pleaded guilty to charges of gross vehicular manslaughter while intoxicated and driving under the influence (DUI), in San Diego Courts February 25, 2010. The accident was a freeway crash which occurred on January 1, 2010, and resulted in the death of a 21 year old pregnant woman and her unborn child.
Sentencing for Joseph Anthony Venegas, which may include sixteen years in prison for the accused drunk driver, is expected at a San Diego Superior Court hearing May 5, 2010.
The circumstances surrounding the DUI accident involved a Mitsubishi Spyder car, being sold by the victim and her husband, developing a flat tire while driven by the prospective purchaser. In an attempt to assist in the disabled vehicle, the victim and other family members went to help.
As the group was waiting for roadside assistance in a parked car, the drunk driver struck their car with a Chevrolet Tahoe. Elaina Luquis-Ortiz, 21, who was six months pregnant was killed instantly.
The family of the victim felt that Venegas should have been charged with murder, but California’s manslaughter law does not provide for the death of a fetus.
This is one more tragic example of how DUI in San Diego can cause grief and pain for more than just the victims themselves.
